Terms of Service

Welcome to Greenhaus Gardening. These Terms of Service ("Terms") form a binding agreement between you and Greenhaus Gardening ("Greenhaus," "we," "us," or "our") covering your use of our website and your purchase of any product we sell ("Products").

Please read these Terms carefully. By browsing our website, creating an account, or placing an order, you agree to be bound by them. If you do not agree, please do not use our website or place an order.

IMPORTANT — Section 17 contains a binding arbitration provision and a class action waiver that affect your legal rights. It requires most disputes to be resolved through individual arbitration instead of in court. You have 30 days to opt out. Please read Section 17 carefully.

Email is currently our primary customer service channel. We aim to respond to all inquiries within 12 hours.


2. Eligibility and accounts

2.1 Age. You must be at least 18 years old, or the age of majority in your state, to place an order. We do not knowingly sell to anyone under 13.

2.2 Accurate information. You agree to provide accurate, current, and complete information when ordering or creating an account, and to keep it updated.

2.3 Account security. You are responsible for keeping your password confidential and for all activity under your account. Email us immediately at info@greenhaus-gardening.com if you believe your account has been compromised.

2.4 Where we sell. Our website is directed to customers in the United States. We make no representation that our Products are appropriate or available elsewhere.


3. Changes to these Terms

We may modify these Terms at any time. The "Last updated" date shows when they were last revised. Changes take effect when posted, but the version in effect when you place an order governs that order. We do not apply changes retroactively to completed purchases.


4. Our Products

4.1 Descriptions and images. We work to describe and photograph our gardening tools, equipment, and planters accurately. We do not warrant that descriptions, images, colors, dimensions, or other content are complete, reliable, current, or error-free.

4.2 Natural materials and finishes. Many of our Products use wood, terracotta, stone, rattan, and untreated metals. Variation in grain, color, texture, and finish is inherent to these materials and is not a defect. Terracotta and stone may show minor surface variation; untreated metals such as copper and steel will develop a patina over time. Colors on screen depend on your display and may differ from the item.

4.3 Dimensions and capacity. Measurements are approximate and subject to normal manufacturing tolerance. Please check dimensions before ordering, particularly for planters, greenhouses, and storage items.

4.4 Assembly. Some Products require assembly. Where assembly is required we say so on the Product page. Follow the supplied instructions — see Section 9.

4.5 Availability. All Products are subject to availability. We may limit quantities, discontinue any Product, and refuse service to anyone for any lawful reason.


5. Pricing, taxes, and payment

5.1 Prices. All prices are in U.S. dollars and may change without notice, but the price in effect when you place your order applies to that order.

5.2 What you pay. The total — Product price, shipping, applicable sales tax, and any import duties we collect under Section 6.4 — is displayed at checkout before you submit your order. We do not add mandatory charges after checkout.

5.3 Sales tax. We collect sales tax in states where we are required to do so, calculated at checkout based on your shipping address.

5.4 Payment. Payment is charged when you place your order. By submitting payment information you represent that you are authorized to use that payment method.

5.5 Pricing errors. If a Product is listed at an incorrect price, we will either contact you for instructions before shipping or cancel and notify you. If we cancel, we issue a full refund. We reserve the right to refuse or cancel any order placed at an incorrect price, whether or not the order was confirmed and charged.


6. Order acceptance, shipping, and delivery

6.1 Order acceptance. Your order is an offer to buy. We accept it when we send you a shipping confirmation email. An order confirmation or payment authorization is not by itself acceptance. We may refuse or cancel an order — for example if the Product is unavailable, if we find a pricing or description error, if we cannot verify your details, or if we suspect fraud. If we cancel a paid order, we refund you in full promptly.

6.2 Shipping origin and timeframes. Products ship from our fulfillment partner located outside the United States. Transit takes longer than domestic shipping. Estimated processing and transit times are shown at checkout and in your confirmation email — please review them before ordering.

6.3 Federal shipping rule. Under the FTC Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435), we will ship within the time stated at checkout, or if no time is stated, within 30 days of receiving your completed order and payment. If we cannot, we will notify you and give you the choice to consent to the delay or cancel for a prompt full refund. If you do not respond to a delay notice, we cancel and refund you. Refunds for canceled orders are issued within 7 business days.

6.4 Import duties and customs. Because we ship from outside the United States, U.S. import duties may apply. The U.S. duty-free de minimis exemption for low-value shipments has been suspended, so duties can apply regardless of order value.

Any import duties, tariffs, or customs fees on your order are included in the total shown at checkout and are paid by us. You will not be billed for customs charges on delivery. If a carrier ever bills you an import charge that was not disclosed at checkout, email us the documentation and we will reimburse you.

6.5 Risk of loss and title. Title and risk of loss pass to you on delivery to your shipping address. If tracking shows delivery but you cannot locate the package, contact us within 7 days and we will work with you and the carrier.

6.6 Incorrect addresses. We are not responsible for orders shipped to an incorrect address you provided. Please verify your address before submitting. If a package returns to us as undeliverable, we will arrange reshipment at your cost or refund you less shipping.

6.7 Oversized items. Greenhouses, large planters, and similar bulky items may ship freight, may require a signature, and may carry additional delivery charges — all disclosed at checkout. Please inspect oversized deliveries before signing and note any visible damage on the carrier's paperwork.

6.8 Destinations. We ship within the United States. We do not currently ship to P.O. boxes, APO/FPO addresses, or international destinations unless stated at checkout.


7. Promotions and discount codes

Discount codes and promotional offers are subject to the terms disclosed with the offer, cannot be combined unless stated, have no cash value, may be modified or discontinued at any time, and cannot be applied retroactively to completed orders.


8. Returns, refunds, and exchanges

8.1 Return window. You may return most Products within 30 days of the delivery date for a refund.

8.2 Condition. Returned Products must be unused, in resalable condition, with all original packaging, parts, hardware, manuals, and tags included. We may decline a refund, or issue a partial refund, for Products returned showing use beyond reasonable inspection. Planters, pots, and containers that have been filled with soil or planted are not returnable.

8.3 How to start a return. Email info@greenhaus-gardening.com with your order number and the items you wish to return before shipping anything back. We will send return instructions and the correct return address. Returns sent without authorization may not be processed.

8.4 Return shipping cost. You are responsible for the cost of return shipping, unless the Product is defective, damaged, or you received the wrong item — in those cases Greenhaus pays return shipping. Use a trackable method; we cannot refund a return we never receive.

8.5 Refunds. Once we receive and inspect your return we will notify you and process your refund to your original payment method within 5 business days of approval. Your bank or card issuer may take a further 3–10 business days to post the credit.

8.6 Original shipping charges. Original shipping is non-refundable on standard returns, but is refunded in full if the Product was defective, damaged, or incorrect, or if we canceled your order.

8.7 Exchanges. For a different size, color, or model, return the original for a refund and place a new order — it is the fastest route.

8.8 Non-returnable items. The following cannot be returned: Products that have been assembled, installed, used, or planted; Products missing original packaging or components; custom, made-to-order, or personalized items; clearance and final sale items marked as such on the Product page; gift cards. These exclusions do not apply to items that arrive defective, damaged, or incorrect.

8.9 Damaged, defective, or wrong items. If your order arrives damaged, defective, or incorrect, email info@greenhaus-gardening.com within 30 days of delivery with photographs of the item and its packaging. We will arrange a replacement, replacement parts, or a full refund including all shipping costs, at no charge to you.


9. Product safety and safe use

9.1 Read the instructions. Gardening tools and equipment can cause injury if misused. Read all instructions, warnings, and safety information supplied with a Product before assembling or using it. Keep tools away from children. Wear appropriate protective equipment. Do not modify a Product or use it for a purpose it was not designed for.

9.2 Assembly. Where a Product requires assembly, follow the supplied instructions exactly. Improper assembly can cause failure and injury. If parts are missing or damaged, stop and contact us before proceeding.

9.3 Load and capacity limits. Do not exceed stated weight, load, or capacity limits for shelving, planters, trellises, greenhouses, or storage products.

9.4 California Proposition 65. California's Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) requires businesses to warn California residents about exposure to listed chemicals. Certain gardening products — including hoses, brass and metal fittings, and some coated or treated components — may contain such chemicals, including lead and phthalates.

Where a Proposition 65 warning applies to a Product, the warning appears on the Product page before you purchase. A typical warning reads:

⚠ WARNING: This product can expose you to chemicals including lead, which is known to the State of California to cause cancer and birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov.

Garden hoses and irrigation products are not intended for drinking water unless expressly labeled as drinking-water safe. Do not drink from a hose that is not so labeled.

9.5 Recalls. If a Product you purchased becomes subject to a safety recall, we will make reasonable efforts to contact you at the email address on your order.


10. Warranties and disclaimers

10.1 Our commitment. We warrant that Products will be free from material defects in materials and workmanship at the time of delivery. Your remedy for a defective Product is the refund, replacement, or replacement parts described in Section 8.9.

10.2 Manufacturer warranties. Some Products carry a manufacturer's warranty. Where one applies, its terms are supplied with the Product. A manufacturer's warranty is in addition to, not a substitute for, the rights described in these Terms and under applicable law.

10.3 Disclaimer. EXCEPT AS EXPRESSLY STATED IN THESE TERMS, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that our website will be uninterrupted, secure, or error-free.

10.4 We do not warrant growing results. Gardening outcomes depend on climate, soil, water, sunlight, pests, technique, and many other factors outside our control. We make no representation or warranty that any Product will produce any particular gardening, growing, or horticultural result.

10.5 State law exceptions. Some states do not allow the exclusion of implied warranties, so the exclusion in Section 10.3 may not apply to you. Where implied warranties cannot be excluded, they are limited to the shortest duration permitted by law. This section does not limit any right you have under the Texas Deceptive Trade Practices–Consumer Protection Act or any other consumer protection statute that cannot be waived. You may have other rights that vary from state to state.


11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GREENHAUS GARDENING AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, CROPS, PLANTS, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS, OUR WEBSITE, OR ANY PRODUCT.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO A PRODUCT OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Nothing in these Terms limits or excludes our liability for fraud, fraudulent misrepresentation, personal injury or death caused by our negligence, or any other liability that cannot lawfully be limited. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above may not apply to you.


12. Indemnification

You agree to indemnify and hold harmless Greenhaus Gardening and its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any law, your misuse of a Product, or your infringement of a third party's rights. We may assume the exclusive defense of any matter subject to indemnification by you, and you agree to cooperate.


13. Intellectual property

All content on our website — text, graphics, logos, photographs, designs, and the Greenhaus Gardening name and marks — is owned by Greenhaus Gardening or its licensors and protected by U.S. and international intellectual property law. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission. You may view and print content for personal, non-commercial use.


14. Customer reviews and submissions

If you submit a review, photograph, comment, or other content, you grant Greenhaus Gardening a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display it in connection with our business, including in marketing. You represent that you own or control the rights to what you submit and that it violates no law or third-party right.

Do not submit content that is false, misleading, defamatory, obscene, harassing, or that impersonates another person. Consistent with the FTC's Rule on the Use of Consumer Reviews and Testimonials, we do not solicit, incentivize, or publish fake reviews, and we do not suppress genuine negative reviews. We may remove content that violates these Terms.


15. Prohibited uses

You agree not to use our website to violate any law; transmit malware; attempt unauthorized access to our systems; scrape or harvest data by automated means; interfere with the security or operation of our website; place fraudulent orders; or infringe the rights of others.


16. Electronic communications and marketing

16.1 Electronic records. By using our website you consent to receive communications from us electronically, and you agree that agreements, notices, and disclosures delivered electronically satisfy any legal requirement that they be in writing, under the federal E-SIGN Act.

16.2 Email marketing. We send marketing email in compliance with the CAN-SPAM Act. Every marketing message includes an unsubscribe link and we honor opt-outs promptly. Opting out does not stop transactional messages about an order you placed.

16.3 Text messages. If you opt in to SMS, you consent to receive automated marketing texts under the Telephone Consumer Protection Act (TCPA). Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help.


17. Dispute resolution — arbitration agreement and class action waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

17.1 Informal resolution first. Before starting arbitration, contact us at info@greenhaus-gardening.com and give us 60 days to resolve the matter informally. Most issues are settled this way. We will do the same before bringing any claim against you.

17.2 Agreement to arbitrate. If we cannot resolve the dispute informally, you and Greenhaus agree that any dispute, claim, or controversy arising out of or relating to these Terms, our website, or any Product will be resolved by binding individual arbitration rather than in court, except as set out in 17.3 and 17.4. This agreement is governed by the Federal Arbitration Act.

17.3 Exceptions — rights you keep.

  • Either party may bring an individual claim in small claims court, so long as it stays individual and in that court.
  • Either party may seek injunctive relief in court for infringement or misuse of intellectual property.
  • Nothing here prevents you from filing a complaint with the Federal Trade Commission, the Consumer Product Safety Commission, your state attorney general, or any other agency. Those agencies may seek relief on your behalf.

17.4 YOUR RIGHT TO OPT OUT. You may opt out of this arbitration agreement within 30 days of first accepting these Terms. Email info@greenhaus-gardening.com with the subject line "Arbitration Opt-Out," including your full name, mailing address, and the email address on your order, stating that you wish to opt out. Opting out will not affect your ability to buy from us or any other part of your relationship with Greenhaus. If you opt out, Section 18 applies to your disputes instead.

17.5 CLASS ACTION WAIVER. YOU AND GREENHAUS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of class proceeding. If this waiver is held unenforceable as to a particular claim, that claim alone is severed from arbitration and brought in court.

17.6 Arbitration procedure. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org, before a single arbitrator. For claims under $10,000, arbitration will be conducted by written submission or telephone unless you request an in-person hearing. Any in-person hearing will be held in the federal judicial district where you reside, or another location you and we agree on.

17.7 Arbitration fees. For any claim of $10,000 or less, Greenhaus will pay all AAA filing, administration, and arbitrator fees, unless the arbitrator finds your claim frivolous or brought for an improper purpose. Larger claims follow the AAA Consumer Arbitration Rules.

17.8 Arbitrator's authority. The arbitrator has exclusive authority to resolve disputes about the interpretation, applicability, or enforceability of this arbitration agreement, except that a court decides the enforceability of the class action waiver in 17.5. The arbitrator may award any relief a court could award on an individual basis. The award is final and binding and may be entered as a judgment in any court of competent jurisdiction.

17.9 Survival. This Section 17 survives termination of these Terms and closure of your account.


18. Governing law and venue

These Terms and any dispute arising from them are governed by the laws of the State of Texas, without regard to conflict of law principles. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

For any dispute not subject to arbitration — including if you opt out under 17.4 — you and Greenhaus agree to the exclusive jurisdiction and venue of the state and federal courts located in Dallas County, Texas.

Nothing in this section deprives you of the protection of any mandatory consumer protection law of the state in which you reside.


19. General provisions

19.1 Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the remainder stays in force.

19.2 No waiver. Our failure to enforce a provision is not a waiver of it or of our right to enforce it later.

19.3 Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.

19.4 Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, war, terrorism, labor disputes, carrier or customs delays, government action, epidemics, or utility and internet failures.

19.5 Entire agreement. These Terms, with our Privacy Policy and any policies referenced on our website, are the entire agreement between you and Greenhaus regarding your use of our website and purchase of Products, and supersede all prior agreements.

19.6 Headings. Section headings are for convenience only.

19.7 Third-party links. Our website may link to third-party sites. We do not control them and are not responsible for their content, products, or privacy practices.
